Arbitration Board of the Paris Lodron University of Salzburg

  • Tasks

One of the main tasks of the Arbitration Board is the resolution of disputes between members of the University of Salzburg. The board aims at an agreement between the disputing parties.
All members of the university are obliged by law (§ 43 UG) to inform the Arbitration Board members in all matters concerning the dispute at hand and to participate in meetings called by the board. The board members are not bound by any directives or orders in their arbitration work.
Disputes which are part of legal proceedings or assessments of performance are not under the responsibility of the Arbitration Board. It can therefore not be called to matters of study, postdoctoral lecture qualification or public services law.
In addition, the Arbitration Board deals with complaints from the Equal Opportunities Working Group concerning

– gender discrimination
– ethnic discrimination
– religious or ideological discrimination
– age discrimination
– sexual orientation discrimination

through a decision of an institution of the university.

Moreover, the Arbitration Board decides on objections to incorrect formations of collegiate bodies.

  • Period of Office

The Arbitration Board of the Paris Lodron University of Salzburg was constituted on March 31, 2004. The University Senate, the University Council and the Equal Opportunities Working Group nominate the six  members of the Arbitration Board for a two-year term of office.        

  • Proceedings/Note on Dispute Mediation

The complaint must be handed in in written, if no solution of the dispute can be reached in the first meeting between the protester and a member of the Arbitration Board. This written complaint is consequently handed over to the opponent so that she/he can state her/his position. Complaints by students can be anonymized.

If no consensus between the disputing parties can be reached, the Arbitration Board can – in certain cases (explanatory statement, significant change in or end of the disputed work relationship or educational relationship) – decide by means of a verdict. The legal conception of the Arbitration Board binds the human resources organ of the university, but the Equal Opportunities Working Group and the concerned university organ can file a complaint at the Higher Administrative Court.
